Scope
These Terms of Service (hereinafter “Terms”) govern the use of the web application dropship (hereinafter “the application”) by the user. By using the application, the user acknowledges these Terms.
The application is a login-free wrapper around the third-party service here.now. It allows you to publish static files (HTML, CSS, JS, images, fonts, PDFs, video, etc.) through the here.now API and receive a public URL in return. Only static content is supported.
The application is not affiliated with here.now. here.now is an independent third party with its own terms of service.
Service description
The application provides the following features:
- Drag and drop of folders, ZIP archives, or individual static files in the browser.
- Client-side extraction of ZIP archives and flattening of wrapper folders so that index.html sits at the root.
- Submission of a file manifest to here.now, parallel upload to presigned URLs, and finalization of the deployment.
- Local storage of a deployment history in the browser (exclusively in localStorage; no server-side storage).
- Optional provision of a here.now API key for authenticated deployments with longer retention.
The application provides its service through the user interface and the transparent proxy routes /api/herenow/[...path] and /api/upload, which forward bytes to here.now or to presigned URLs without logging or storage. The actual publishing, storage, and delivery of content is performed by here.now.
No uptime guarantee and retention
Availability
No uptime guarantee (SLA) is provided for the application. The application may be changed, restricted, or discontinued at any time and without prior notice. In addition, the availability of published content depends on here.now and, where applicable, its infrastructure partners, over which the operator has no influence.
Retention and data loss
No independent guarantee is provided regarding the retention of published content. The retention period depends exclusively on the deployment mode:
- Anonymous deployments normally expire automatically after 24 hours and are then deleted by here.now.
- Authenticated deployments (with an API key) follow the retention rules of the respective here.now API key or account and may persist indefinitely or for a limited period.
The deployment history stored locally in the browser is not part of here.now's storage and remains in the browser only until the user deletes it or wipes browser storage. There is no server-side backup.
User responsibility and prohibited content
The user is solely responsible for the content they publish through the application. This includes, in particular, the lawfulness of the content, the protection of copyright, name, trademark, personality, and other third-party rights, and compliance with applicable statutory provisions.
Prohibited content includes, but is not limited to:
- illegal, criminal, youth-endangering, hate-inciting, or extremist content;
- malicious content such as malware, phishing pages, exploits, or other content intended to compromise third parties;
- content that infringes the rights of third parties (copyright, trademark, personality, privacy rights, etc.);
- spam, fraudulent, or misleading content, including fake shops, fake login pages, and pyramid schemes;
- content that violates the here.now terms of service.
here.now may independently remove or block prohibited content. The application may remove deployments that violate these Terms from the local history at any time and may discontinue cooperation with the user without giving rise to any claim.
Limitation of liability
The operator's liability is unlimited only in cases of intent and gross negligence, and for damage to life, body, or health. For slight negligence, the operator is liable only for breach of an essential contractual duty (cardinal duty) whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance the user may regularly rely, and then only up to the amount of the typical, foreseeable damage.
No liability is assumed for the availability, integrity, or retention of content published via here.now. In particular, the application is not liable for a deployment remaining permanently accessible, for here.now sites not being deleted before the end of the regular 24-hour period, or for the locally stored deployment history surviving a defect in the browser, device, or localStorage.
Liability under the Product Liability Act and for a guaranteed quality remains unaffected.
Third-party integration (here.now, Cloudflare)
The application uses the independent third party here.now, which performs the actual publishing and delivery of content. here.now may rely on infrastructure operated by Cloudflare, Inc. when processing data. The services of these third parties are governed exclusively by their own terms of service and privacy policies. The application's operator has no influence over the processing carried out there.

Amendments to these Terms
The operator reserves the right to amend these Terms at any time and without prior notice, provided that the amendment is reasonable for the user. This applies in particular to adaptations required by technical or legal changes in the underlying services (including changes to the here.now API or terms of service). The “Last updated” date above indicates when this version was last revised. The version current at the time of use is authoritative in each case.
Applicable law and jurisdiction
German law shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). If the user is an entrepreneur within the meaning of § 14 BGB (German Civil Code), a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction shall be the seat of the operator:

Severability clause
Should any provision of these Terms be wholly or partially invalid or unenforceable, or become so, the validity of the remaining provisions shall remain unaffected. In place of the invalid or unenforceable provision, a provision shall apply that comes closest in a legally permissible manner to the economic purpose of the invalid provision. The same shall apply mutatis mutandis to regulatory gaps.
